Our Zero-Tolerance Stance on Spam

Bulk SMS Now is committed to being a trusted provider of messaging solutions. We have a strict zero-tolerance policy against spam and any abusive messaging practices. The term “spam” refers to any unsolicited, irrelevant, or inappropriate bulk electronic message.

This Anti-Spam Policy is an integral part of our Terms and Conditions and Acceptable Use Policy. By using our Services, you agree to abide by this policy and all applicable laws and regulations. We reserve the right to suspend or terminate, without warning, any account that violates this policy.

  1. What Constitutes Spam?

Spam is not just what is in the message content, but also how the recipient’s contact information was obtained and whether the required permissions are in place. You are prohibited from sending any message that qualifies as spam. This includes, but is not limited to, messages that:

  • Are sent to recipients who have not provided prior express consent to receive communications from you.
  • Do not clearly identify yourself or the entity on whose behalf you are sending the message.
  • Contain false or misleading information in the subject line, content, or sender information.
  • Are sent to purchased, rented, scraped, or harvested phone number lists.
  • Do not provide a clear and functional opt-out mechanism.
  1. Your Legal Obligations & Proof of Consent

As a user of our Services, you are solely responsible for ensuring your messaging campaigns comply with all anti-spam laws in the country where you are based and in the recipient’s country. Key laws include:

  • United States: The Telephone Consumer Protection Act (TCPA) and the Controlling the Assault of Non-Solicited Pornography And Marketing (CAN-SPAM) Act.
  • Canada: Canada’s Anti-Spam Legislation (CASL).
  • Australia: The Spam Act 2003.
  • European Union/UK: The Privacy and Electronic Communications Regulations (PECR) and the General Data Protection Regulation (GDPR).

Proof of Consent is Mandatory: You must obtain and maintain verifiable proof of consent for every recipient on your list. Consent must be:

  • Prior: Gained before any message is sent.
  • Express: The recipient must have explicitly agreed to receive messages from you (e.g., by ticking an unchecked opt-in box, filling out a form, or sending a keyword to a number). Implied consent is rarely sufficient and is highly regulated.
  • Informed: The recipient must have been told what type of messages they would receive and how often.

Upon our request, you must provide this proof of consent within 7 business days. Failure to do so will be treated as a violation of this policy.

  1. Rules for Sending Messages

To ensure compliance, every message you send must adhere to the following rules:

  • Clear Identification: The message must clearly identify you (the sender) or the business or organization on whose behalf you are sending the message.
  • Valid Sender ID: You must not falsify or use a Sender ID (alphanumeric name) that you are not legally entitled to use or that misrepresents your identity.
  • Unsubscribe (Opt-Out) Mechanism: Every single message must include a clear, conspicuous, and free way for the recipient to opt-out of all future messages from you. Standard methods include:
    • “Reply STOP to unsubscribe”
    • “Text STOP to opt-out”
    • A link to a functional unsubscribe web page
  • Honor Opt-Outs Immediately: You must process and honor all opt-out requests immediately and must not charge a fee for this. You must not attempt to contact that recipient again for promotional purposes.
  1. Prohibited Content and Industries

You are strictly prohibited from using our Services to send messages related to certain high-risk industries known for spam and abuse, including but not limited to:

  • Payday loans, short-term financing, and debt collection services.
  • Gambling, casinos, and sports betting.
  • Adult content, pornography, and escort services.
  • Pharmaceutical products, prescription drugs, or telehealth services without proper licensing.
  • Cannabis, CBD, and related products (without our prior written approval).
  • “Get rich quick” schemes, multi-level marketing (MLM) with questionable models, or work-from-home opportunities.
  • Any content that is illegal, fraudulent, threatening, or harassing.
  1. Enforcement and Reporting Violations
  • Monitoring: We actively monitor messaging traffic for patterns indicative of spam, such as high volumes of messages, high complaint rates, and low engagement.
  • Your Cooperation: You agree to cooperate with us in the investigation of any suspected spam or violation.
  • Consequences: If we determine, in our sole discretion, that you are violating this policy, we may take immediate action without prior notice, including:
    • Issuing a formal warning.
    • Immediately suspending or terminating your account.
    • Forfeiting any unused credits in your account without refund.
    • Reporting your activities to relevant legal and regulatory authorities.
    • Imposing a financial penalty to cover costs incurred due to blacklisting or reputational damage.
  • Reporting Spam: If you suspect that a message sent via Bulk SMS Now’s platform is spam, or if you wish to report any abuse of our Services, please contact us immediately at customersupport@bulksmsnow.com.au. Please include the message content and the phone number it was sent from.
