This Acceptable Use Policy (“Policy”) outlines the prohibited activities and content standards governing your use of the messaging services (“Services”) provided by Bulk SMS Now (“we,” “us,” “our”). This Policy is an integral part of our Terms and Conditions.
By accessing or using our Services, you (“you,” “your,” “Customer”) agree to comply with this Policy. We may modify this Policy at any time by posting a revised version on our website. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Policy.
- Zero Tolerance for Abuse and Spam
Bulk SMS Now is committed to preventing unsolicited messages (spam) and abusive practices. Your use of our Services must comply with all applicable laws and regulations in the country from which you send messages and the country where the recipient is located, including but not limited to the Telephone Consumer Protection Act (TCPA) in the U.S., the Spam Act in Australia, Canada’s Anti-Spam Legislation (CASL), and the Privacy and Electronic Communications Regulations (PECR) in the UK.
- Prohibited Content
You are prohibited from using our Services to send, or facilitate the sending of, any content that is, or that we deem to be:
- Illegal or Harmful: Content that is unlawful, libelous, defamatory, fraudulent, or promotes illegal activities.
- Malicious: Content containing viruses, worms, Trojan horses, or any other code of a destructive or deceptive nature.
- Threatening or Harassing: Content that is threatening, abusive, harassing, or invades another’s privacy.
- Offensive: Content that is obscene, pornographic, indecent, or hateful.
- Infringing: Content that infringes upon any patent, trademark, trade secret, copyright, or other intellectual property rights of any party.
- Misleading or Deceptive: Content that is false, misleading, or deceptive, including phishing operations or impersonation of another person or entity.
- Prohibited Practices
In addition to content restrictions, you are prohibited from engaging in the following activities:
- Sending Spam: You must not send any unsolicited messages. You must have prior, express, and provable consent from every recipient before sending them a message.
- Fraudulent Activity: You must not use the Services for any fraudulent or deceptive purpose, including smishing (SMS phishing), pyramid schemes, or scams.
- Harvesting & List Generation: You must not use the Services to generate or harvest phone numbers through automated means (scraping, generating, etc.).
- Falsifying Information: You must not manipulate or falsify message originator information (e.g., sender ID), or use a sender ID you are not entitled to use.
- Reverse Engineering: You must not reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of any part of our Services.
- Network Disruption: You must not engage in any activity that disrupts, interferes with, or burdens our networks, servers, or other infrastructure.
- Unapproved High-Risk Industries: You must not use the Services for industries we deem high-risk without our prior written consent. Prohibited industries include, but are not limited to:
- Payday loans, short-term high-interest loans, or loan forgiveness services.
- Debt collection or forgiveness services.
- Gambling, casinos, and sports betting.
- Adult content, dating services, or escort services.
- Pharmaceutical products (without proper licensing).
- Cannabis, CBD, and related products (without prior written approval and proof of legal compliance).
- Multi-level marketing (MLM) with questionable business models.
- Work-from-home, “get rich quick,” or other high-risk financial opportunities.
- Consent and Identification Requirements (Critical Rules)
- Proof of Consent: You are solely responsible for obtaining and maintaining proof of recipient consent. Upon our request, you must provide this proof within 7 business days.
- Clear Identification: Every message must clearly identify you (the sender) and, if applicable, the name of the company or entity on whose behalf the message is being sent.
- Opt-Out Requirements: Every message must include clear and simple instructions for the recipient to opt-out of future messages (e.g., “Reply STOP to unsubscribe”). You must honor all opt-out requests immediately and must not charge a fee for this service. You must not send any further messages to a recipient who has opted out.
- Enforcement
We reserve the right to monitor your use of the Services for compliance with this Policy. We may, at our sole discretion:
- Review and Investigate: Review your message content and account activity.
- Request Information: Request documentation proving recipient consent.
- Take Action: Take any action we deem appropriate in case of a violation, including, but not limited to:
- Issuing a warning.
- Suspending your account immediately.
- Terminating your account permanently.
- Reporting your activities to relevant legal authorities.
- Refusing to refund any unused account credits.
